Terms of Service

Deposit or part payment may be required for some projects.  Deposits will not be returned for change of mind or project cancellation.  On completion of your project, all invoices will be required to be paid within 30 days unless otherwise discussed.  Failure to pay will result in the deletion of your site and removal from hosting if applicable.

All my design is transparent, and the client will have full access to the WordPress dashboard after the initial build is ready for review.  I offer two comprehensive design revisions in the initial quote.  Any further design revisions will be undertaken for an agreed upon price after discussion with the client.

Upon invoicing, a project will be considered complete.  Any further changes or maintenance outside of the included 30 day functionality monitoring will be charged at my normal hourly maintenance fee.

Unfortunately web infrastructure changes, so I can’t take any responsibility for any future browser or device compatibility.  All my designs are responsive, so at the time your project is completed it will be browser and device compatible.  Any future changes to ensure device and browser compatibility will be charged at my normal hourly maintenance fee.

At the beginning of a project, I will always try to give an estimate of when you can assume your site will go online.  This estimate will be adhered to and not delayed unless specifically requested by the client.  To ensure that the agreed upon deadline is met, the client, in turn, must agree to appoint a single point of contact for client side communications, respond promptly, and ensure that all content to be included on the site is provided by an agreed upon time in development.

All content, from text, images, sound and video files must be provided by the customer unless discussed with me directly before the acceptance of a quote.  Any extra services such as logo design, asset creation or content writing will be charged and invoiced accordingly.

I need the full disclosure of all project requirements before acceptance of any quote.  Failure to disclose information relevant to any project may effect a change in the final cost of the project and the final delivery date.  By accepting my offer of work, you agree to provide all information relevant to the project before the acceptance of any quote.  If pertinent information is not disclosed the final project may be delayed and incur a 25% surcharge.

Despite what some might tell you, there are no guarantees where SEO is concerned.  I can never guarantee that you will be on the first page of Google, but I can help you implement good SEO strategy that will help you get there.

Google favours high-quality content above all else, so I will apply keywords where I can, and will always advise you on best practice so you can ensure that your content is working toward increasing your SEO score. Maintaining SEO ranking will require regular updates on the part of the client, so having a strategy in place is a must.

I have helped my clients rank highly on search engines, but can not accept responsibility for unfavourable rankings.  Some variables can affect SEO score that need constant monitoring and maintenance.  I will write and edit your content if required by your project to ensure maximum SEO exposure, and all page builds will include relevant keywords. However, I can not accept responsibility for any drops in search engine rankings.

Any keywords required for your SEO must be provided before beginning the project so your pages can be built and designed with SEO in mind.  All content provided must include these keywords and be delivered in a timely fashion, or a request for editing or re-written content contained in the original quote for the project or purchased as an extra service.

If the content provided is not high quality and does not contain relevant keywords, I can not be held responsible for any failure to rank in search engines.

I take my clients’ privacy very seriously.  I will never pass your personal information on to any third party for marketing or advertising purposes.  Your site details will be held securely and all relevant passwords or login information passed to you on completion of your project.

For payment, I prefer a direct bank transfer or PayPal as the most secure method of payment for online transactions.

Should your website, hosting provider of social media services be hacked, I can not be held responsible for the security of your data.  I am not liable for any loss of service, or breach of information in these circumstances.

The client retains all rights to the web, logo and asset design I provide after completion of the project, with the agreement that design credit remains with Endeavour Design with a link back to my website.

The client also agrees to allow their website and assets to be used as part of my portfolio.

If a client wishes to terminate my services partway through a project, this termination will be honoured effective immediately by Endeavour Design.  All termination requests must be given in writing or via email in order to take effect.

Upon termination, the client will lose any deposit paid and be invoiced for all work undertaken up to the day that services cease.  All outstanding monies must be paid within 30 days of receiving the final invoice, after which all relevant assets, passwords and login information will be turned over to the client.

I accept no liability for misuse of your website or design assets including but not limited to false advertising, illegal activity, and fraud.  I accept no liability for any possible negligence or malpractice on your behalf.

All web content, including data, images, video, sound assets or text remains the sole property of the client unless otherwise agreed.

Endeavour Design is not responsible for obtaining the copyright permissions of any data, images, video or sound assets used by or provided by the client.  I bear no responsibility for any failure on the part of the client to receive the correct permissions, or for the misuse of any assets for their website.

On request, evidence of copyright permissions must be provided.  Should a client fail to produce these permissions, there may be a resultant delay in services for which Endeavour Design can not be held responsible.  If copyright permissions can not be produced on request, I have the right to terminate services immediately and charge a discretionary 25% surcharge for any resultant work undertaken.

Endeavour Design is excluded from any liability for the following:

• Loss or damage caused by web downtime;

• Loss or damage caused by inaccuracy or omission of information;

• Loss or damage caused by malicious interference, such as hacking;

• Loss or damage caused by delay, error or negligence in the creation of your website;

• Loss or damage to image, video, text or sound files supplied for the site;

The liability of Endeavour Design to the client will be limited to the charges incurred by the client for the services provided by Endeavour Design.
